Terms of Service

These Terms of Service ("Terms") govern your use of LocaToWeb, including the LocaToWeb mobile applications, website, and related services (collectively, the "Service").

By using LocaToWeb, you agree to these Terms. If you do not agree with them, you should not use the Service.

1. About LocaToWeb

LocaToWeb is a location tracking and mapping service that allows users to record their position and routes, view them on maps, and optionally share location information and other content with others.

Some features may require a paid subscription or purchase.

2. Use of the Service

You may use LocaToWeb only for lawful purposes and in accordance with these Terms.

You are responsible for how you use the Service and for ensuring that your use complies with applicable laws and regulations.

You must not use LocaToWeb to:

• Track or monitor another person without their knowledge or where doing so would be unlawful.

• Harass, threaten, stalk, impersonate, or harm another person.

• Upload or share unlawful, abusive, misleading, or otherwise inappropriate content.

• Attempt to gain unauthorized access to the Service, its systems, or other users' data.

• Interfere with or disrupt the operation or security of the Service.

• Use the Service in any other unlawful or fraudulent manner.

We may restrict or terminate access to the Service where we reasonably believe these Terms have been violated or where necessary to protect LocaToWeb, its users, or third parties.

3. Location Information and GPS Accuracy

LocaToWeb relies on location information provided by your device and on services and infrastructure provided by third parties.

GPS positions, routes, elevations, distances, speeds, maps, and other location-related information may be inaccurate, delayed, incomplete, or unavailable.

Location updates may also be affected by factors including device settings, GPS reception, internet connectivity, battery-saving features, operating-system restrictions, and background-processing limitations.

You should not rely on LocaToWeb as your only means of navigation, safety, rescue, or emergency communication.

Always use appropriate equipment, maps, navigation methods, safety procedures, and judgment for the activity you are undertaking.

4. Sharing Your Location

LocaToWeb allows you to share your location, routes, and other information with other people.

You are responsible for deciding what information you share and with whom you share it.

When you make information public or provide access to another person, that information may be viewed, copied, saved, or shared by others outside our control.

You should therefore consider carefully before making your location or other personal information available to others.

5. User Content

You may be able to upload or provide content such as track information, photos, messages, names, descriptions, or other information ("User Content").

You retain ownership of your User Content.

By submitting User Content to LocaToWeb, you grant us the rights necessary to store, process, transmit, display, and otherwise use that content for the purpose of operating and providing the Service.

You are responsible for the content you submit and must have the necessary rights and permissions to provide it.

We may remove or restrict access to content that violates these Terms, applicable law, or the rights of others.

6. Maps and Third-Party Services

LocaToWeb may use maps, location information, payment systems, hosting services, and other services provided by third parties.

The availability, accuracy, and terms of these third-party services are outside our control and may change over time.

Map information should not be assumed to be complete or current. Roads, trails, terrain, boundaries, hazards, access restrictions, and other geographic information may differ from actual conditions.

7. Accounts and Access

Some LocaToWeb features may require an account, device identifier, subscription, or other form of authentication.

You are responsible for protecting access to your account and devices and for activity performed through them.

You must not attempt to access another user's private information without authorization.

8. Paid Services and Subscriptions

Some features of LocaToWeb require payment.

Where subscriptions are purchased through Apple App Store or Google Play, billing, renewals, cancellations, and refunds are generally handled by the relevant app store and are also subject to its terms.

Subscriptions may automatically renew unless cancelled in accordance with the terms of the platform through which they were purchased.

Prices and available subscription plans may change. Changes will not affect an already-paid subscription period unless otherwise stated or required by law.

Any statutory rights you have as a consumer remain unaffected.

9. Service Availability

We aim to keep LocaToWeb reliable and available, but we do not guarantee uninterrupted or error-free operation.

The Service may occasionally be unavailable or limited because of maintenance, technical problems, network failures, third-party services, circumstances outside our control, or other reasons.

Features may be added, modified, restricted, or discontinued over time.

Where reasonably possible, significant changes affecting paid services will be handled in a way that respects applicable consumer laws.

10. Safety and Emergencies

LocaToWeb is not an emergency service, rescue service, or safety monitoring service.

Sharing your location through LocaToWeb does not guarantee that another person is actively monitoring your position or will notice if you stop moving, lose connectivity, experience an emergency, or require assistance.

If you are participating in activities where injury, getting lost, weather, terrain, or other hazards may present a risk, you should take appropriate independent safety precautions.

In an emergency, contact the appropriate emergency services using normal emergency communication methods whenever possible.

11. Limitation of Liability

To the maximum extent permitted by applicable law, LocaToWeb is provided on an "as is" and "as available" basis.

We do not guarantee that location information, maps, routes, elevation information, tracking data, or other information provided through the Service will always be accurate, complete, current, or available.

To the extent permitted by law, we are not responsible for indirect or consequential losses resulting from the use of, or inability to use, the Service.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including rights you may have under applicable consumer protection law.

12. Intellectual Property

The LocaToWeb name, software, website, design, branding, and other materials provided as part of the Service are owned by us or our licensors and are protected by applicable intellectual property laws.

These Terms do not give you ownership of the Service or its intellectual property.

You may not copy, modify, distribute, reverse engineer, resell, or commercially exploit the Service except where expressly permitted by us or by applicable law.

13. Privacy

Our handling of personal information is described in our Privacy Policy.

Because location information can be sensitive, we encourage you to review the Privacy Policy and understand how your information is collected, stored, used, and shared.

14. Suspension and Termination

You may stop using LocaToWeb at any time.

We may suspend or terminate access to the Service where necessary because of misuse, violation of these Terms, security concerns, legal requirements, or circumstances that could cause harm to LocaToWeb, its users, or third parties.

Where appropriate and reasonably possible, we will provide notice before terminating access to a paid service.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes to LocaToWeb, applicable laws, or our business practices.

The latest version will be made available through our website or application.

For significant changes, we may provide additional notice where appropriate or required by law.

Continued use of the Service after updated Terms take effect constitutes acceptance of the updated Terms, except where applicable law requires another form of consent.

16. Governing Law

These Terms are governed by Norwegian law, except where mandatory consumer protection laws in your country of residence provide otherwise.

Any disputes should, where possible, first be resolved by contacting us.

Nothing in these Terms limits any mandatory rights or remedies available to consumers under applicable law.
